While nations may agree in principal to free trade and market access, considerations like protecting local industry, negating unfair pricing and so on make them resort to trade remedies and the governmentalso seek counsel and views in imposing them. WTO complaint, Trade Remedies such as anti-dumping duties, subsidies and countervailing measures and safeguard duties are being used by member nations and they have far reaching implications for the importer and exporter.

India is a major user of the anti-dumping instrument. Handling representation before the investigatingauthorities and judicial review forums are two major areas of work in this domain. A domestic industry may seek imposition of anti-dumping duty or and exporter/importer may oppose the levy of antidumping duty and would require representation in India or other Appellate proceeding are also conducted before Indian Tribunals, High Courts and the Supreme Court.

Indian is also a frequent user of safeguard measures when there is a sudden surge of imports. Unlike anti-dumping or countervailing measures, safeguard measures are applicable to all imports irrespective of the country of origin. The Indian domestic industry, importers, foreign exporters and other governments are called upon to present their case satisfactorily before the Indian safeguard authorities as well as before the judicial authorities to ensure that there is no abuse of the procedure.
